Terms and Conditions of Sale

This English translation is provided for information only. In the event of any discrepancy, the French version shall prevail. These terms of sale are entered into between, on the one hand, the company SHOPNETWORK RACING, whose registered office is at Papesoleil, 87000 Limoges, France, registered with the Trade Register, hereinafter referred to as “SHOPNETWORK RACING”, which operates the website www.shopnetwork.fr, and, on the other hand, any natural or legal person wishing to make a purchase via the website www.shopnetwork.fr, hereinafter referred to as “the buyer”.

Article 1. Purpose

These terms of sale set out the contractual relationship between SHOPNETWORK RACING and the buyer, and the conditions applicable to any purchase made through the website www.shopnetwork.fr. Purchasing a product through this website implies the buyer’s unreserved acceptance of these terms of sale, which the buyer acknowledges having read before placing the order. Before any transaction, the buyer declares, first, that the purchase of products on the website www.shopnetwork.fr has no direct connection with their professional activity and is limited to strictly personal use and, second, that they have full legal capacity to commit themselves under these terms and conditions of sale. SHOPNETWORK RACING reserves the right to amend these terms of sale at any time, in order to comply with any new regulation or to improve the use of its website. The applicable terms will therefore be those in force on the date the buyer places the order.

Article 2. Products

The products offered are those shown on SHOPNETWORK RACING’s website www.shopnetwork.fr, subject to availability. SHOPNETWORK RACING reserves the right to change its product range at any time. Each product is presented on the website with a description of its main technical characteristics (capacity, use, composition, etc.). The photographs are as faithful as possible but are not binding on the Seller. The products presented on the website www.shopnetwork.fr are offered for sale to all buyers residing in countries that fully authorise the entry of these products into their territory.

Article 3. Prices

The prices shown on the product pages of the online catalogue are in euros (€), inclusive of all taxes, and take into account the VAT applicable on the day of the order. Any change in the VAT rate may be passed on to the price of the products. SHOPNETWORK RACING reserves the right to change its prices at any time, it being understood that the price shown in the catalogue on the day of the order is the only one applicable to the buyer. The prices shown do not include delivery charges, which are invoiced in addition to the price of the products purchased, depending on the total amount of the order. In mainland France, delivery is free for any order of 70 euros or more, taxes included.

Article 4. Orders and payment terms

Before placing any order, the buyer must create an account on the website www.shopnetwork.fr. The account creation section can be reached directly from the side menu bar. On each visit, the buyer must log in with these details in order to place an order or view their account (order status, profile, etc.). SHOPNETWORK RACING invites the buyer to order and pay for products in several steps, with a choice of 3 payment options:

Payment by bank transfer

Secure payment by PayPal or by card: Visa, Mastercard, American Express, Apple Pay, Google Pay, Carte Bleue and many more.

Confirming an order implies acceptance of these terms of sale, acknowledgement of having full knowledge of them, and a waiver of the right to rely on the buyer’s own terms of purchase. All the data provided and the recorded confirmation shall constitute proof of the transaction.

Article 5. Retention of title

SHOPNETWORK RACING retains full ownership of the products sold until the price has been collected in full, including principal, charges and taxes.

Article 6. Right of withdrawal

In accordance with the provisions of the French Consumer Code, the consumer has, in principle, a period of fourteen (14) days from receipt of the order to exercise the right of withdrawal, without having to give reasons or bear any costs other than those of returning the product.

However, in accordance with Article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for goods made to the consumer’s specifications or clearly personalised.

As the products sold by SHOPNETWORK RACING are made to order and personalised according to the customer’s choices (text, design, logo, colour, model, size or any other personalisation requested), they fall within this statutory exception.

Consequently, no order cancellation, withdrawal, return, exchange or refund can be accepted once the order has been confirmed, except in the event of a manufacturing defect or an error attributable to SHOPNETWORK RACING.

It is the customer’s responsibility to check all the details of their order with the greatest care before final confirmation.

Article 7. Delivery

Deliveries are made to the address given on the order form, which must be within the agreed geographical area. In most cases, orders are shipped by La Poste via COLISSIMO, a tracked delivery service, delivered without signature. Delivery times are given for guidance only. They may vary depending on order volume, the specific nature and personalisation of the order, or the time of year (holidays, public health events, etc.).

Article 8. Warranty

All products supplied by SHOPNETWORK RACING are covered by the statutory warranties in force, in particular the legal guarantee of conformity and the warranty against hidden defects provided for by French law.

In the event of a manufacturing defect, an error attributable to SHOPNETWORK RACING, or a product that does not conform to the order confirmed by the customer, the customer must contact customer service as soon as possible so that a suitable solution can be offered. After verification and prior agreement from SHOPNETWORK RACING, the product may be replaced or refunded, as appropriate.

However, as the items offered by SHOPNETWORK RACING are made to order and personalised to the customer’s specifications, they cannot be returned, exchanged or refunded in the event of a change of mind, an ordering error, a wrong choice of size, colour or model, or for any other reason of personal convenience.

In accordance with the provisions of Article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for goods made to the consumer’s specifications or clearly personalised.

It is therefore the customer’s responsibility to check carefully all the details of their order (sizes, designs, text, colours, personalisation options and delivery details) before final confirmation.

Every confirmed order is considered firm and final.

Article 9. Liability

In the distance-selling process, SHOPNETWORK RACING is bound only by a best-efforts obligation. It cannot be held liable for damage resulting from use of the Internet, such as loss of data, intrusion, viruses, service interruption or other unintentional problems.

Article 10. Intellectual property

All elements of the website www.shopnetwork.fr are and remain the exclusive intellectual property of SHOP NETWORK. No one is authorised to reproduce, exploit or use for any purpose whatsoever, even in part, any elements of the website, whether photographs, logos, designs or text.

Article 11. Personal data

SHOPNETWORK RACING undertakes to keep confidential the information provided by the buyer for the use of certain services. Any information concerning the buyer is subject to the provisions of French Act No. 78-17 of 6 January 1978. The user has the right to access, amend and delete information concerning them, and may make such a request at any time by writing to the following address: [email protected].

Article 12. Returns policy

Any claim for misprinted, damaged or defective items must be submitted within 30 days of receiving the product. For parcels lost in transit, all claims must be submitted no later than 30 days after the estimated delivery date. Claims deemed to result from an error on our part are covered at our expense.

If you notice a problem with the products or any other aspect of your order, please report it via our contact form.

Wrong address: if you provide an address that the carrier considers insufficient, the shipment will be returned to our shipping department. You will be responsible for the reshipping costs once we have confirmed an updated address with you (where applicable).

For health and hygiene reasons, Shopnetwork Racing does not accept returns of products that have been opened and worn.

We do not refund orders in the event of buyer’s remorse. Product returns and size exchanges are at the buyer’s expense. A withdrawal request will be assessed to check whether the product has been used or damaged, even partially. In such cases, no refund will be possible.

Notice to EU consumers: in accordance with Article 16(c) and (e) of Directive 2011/83/EU of the European Parliament and of the Council of 25 October 2011 on consumer rights, the right of withdrawal may not be provided for:

the supply of goods made to the consumer’s specifications or clearly personalised;
sealed goods which have been unsealed after delivery and are therefore not suitable for return for health protection or hygiene reasons,

Shopnetwork Racing therefore reserves the right to refuse returns at its sole discretion.

Article 13. Dispute resolution

These distance-selling terms are governed by French law. Any dispute or litigation shall be brought before the competent court of Limoges.
